Annuity and Life Insurance Beneficiary Designation Rules

17 of the 20 life insurance forms that address class gifts accept a designation such as “all living children”, which bank and brokerage forms mostly refuse. All 4 annuity forms that mention per capita make it the default, and Sammons says “If an election is not made then by default it will be per capita.”

The listings below give the annuity and life insurance beneficiary rules of 30 insurers, brokerages and recordkeepers, read from each company’s own beneficiary change forms, applications and contract materials between September 24 and 27, 2026. 48 of the 48 listings that address trusts let the owner name one.

What the Insurance Forms Say

  1. Class gifts. Nationwide says “If beneficiary(ies) are not specified by name (i.e. all living children), the Company is authorized to rely on an affidavit(s)” to identify the class at claim. Brighthouse says “You have the option to include all future children (born or adopted by the Insured) as Primary Beneficiaries or as Contingent Beneficiaries”. 8 of the 10 annuity forms that address class gifts accept them too.
  2. Per capita can mean something else. New York Life’s annuity form uses per capita to mean that “if one of the beneficiaries were to pass away or disclaim, the shares would be distributed evenly amongst the surviving beneficiaries”, which is a rule about survivors and not a split among generations.
  3. Per stirpes can stop at one generation. Lincoln’s annuity form defines per stirpes to mean that “the beneficiary's share of the proceeds will be paid to that beneficiary's living children in equal shares.” If the beneficiary’s child has also died, that child’s own children take nothing under that definition.
  4. Every change restates everything. Nationwide says “We will also not accept wording such as "same" or "no change"”, so each change form must list every beneficiary again.
  5. Product rules differ inside one insurer. Pacific Life offers per stirpes on its life policies, but on structured settlement annuities it says “Per Stirpes ... beneficiary designations are not supported.”
