Payable on Death Account Rules at 144 Banks and Credit Unions

At least 95 of the 117 bank and credit union agreements that say what happens when a payable-on-death beneficiary dies first give that share to the beneficiaries still living, and the predeceased beneficiary’s children receive nothing from the account. 5 banks refuse to take a trust as a payable-on-death beneficiary, and American Express says “Beneficiaries named on POD accounts must be individuals; POD accounts cannot be set up in the names of trusts.”

The listings below give the payable-on-death rules of 88 banks, 55 credit unions and one brokerage cash account, read from each institution’s own deposit or membership agreement and POD form between September 24 and 27, 2026. 51 of them are Florida institutions, 12 banks and 39 credit unions, and the Florida filter below shows them alone. Most banks publish a deposit agreement that says who takes at death and little else, so many listings say “Not stated” on points the bank would answer on its own POD form.

What the POD Agreements Say

  1. A predeceased beneficiary’s share. Grow Financial, a Florida credit union, says “The share of any beneficiary who predeceases the account owner will be split equally among the remaining living POD beneficiaries.” MidFirst Bank pays each beneficiary “if living, and if not living, to the named estate of the beneficiary.” Huntington’s Indiana terms pass a predeceased lineal descendant’s share to his or her own descendants.
  2. When nobody survives. 52 of the 56 agreements that say who takes when no beneficiary survives point to the owner’s estate, which usually means probate. Grow Financial says “If all named POD beneficiaries pre-decease the account owner(s) the applicable funds shall be paid to the estate of the last surviving account owner.”
  3. Trusts. 17 of the 22 POD documents that address the point allow a trust. American Express National Bank, Ameriprise Bank, Capital One, CIBC Bank USA and Goldman Sachs Bank USA do not. Bank OZK says “You may name a single non-natural person as a beneficiary.” Navy Federal accepts a trust but says “If a Legal Trust is named as Primary Beneficiary, Contingent Beneficiary(ies) shall not receive proceeds unless the Legal Trust was properly terminated or revoked prior to the Primary Member's death.” Tropical Financial, a Florida credit union, pays the account “to the successor trustee for the trust beneficiary designated on your separate Certification of Trust.”
  4. Every person by name. 13 of the 14 POD documents that address class gifts want each beneficiary listed. Navy Federal says “Beneficiaries cannot be added without the full name, address, date of birth, and Social Security number.” 10 institutions also cap the number of beneficiaries, from 3 primary and 3 contingent at M1 to 10 at Ally Bank and Capital One.
